By accessing the website, making a purchase, or entering the Rental Programme, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the site or enter into any agreement with Gromstar.

1.3 User Conduct

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the website. Prohibited behaviour includes, but is not limited to, harassment, impersonation, and the transmission of harmful or offensive content.

1.4 Limitation of Liability

Gromstar shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our website or any products purchased through it. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

1.5 Changes to Terms

Gromstar reserves the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the website following any changes constitutes your acceptance of the new Terms of Service.

1.6 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

2. Terms of Sale

These terms apply to purchases of components, accessories, bikes, and any other non-rental products.

2.1 Product Information

Gromstar strives to provide accurate descriptions of our products. However, we do not warrant that product descriptions or other content on our website is accurate, complete, reliable, current, or error-free. If a product offered by Gromstar is not as described, your sole remedy is to return it in unused condition.

2.2 Pricing & Payment

All prices shown on the website are inclusive of applicable taxes unless stated otherwise.

We reserve the right to change prices at any time.

2.3 Order Acceptance

An order is not confirmed until you receive a dispatch notice from us. We reserve the right to refuse or cancel any order.

2.4 Delivery

Delivery times shown on the website are estimates, not guarantees. We aim to dispatch orders promptly, but delays can occur. Once the product is delivered to the address you provided, responsibility for the item transfers to you. Ownership transfers only after full payment has been received.

2.5 Returns & Refunds

You may return products within the period permitted under UK consumer law, provided they are unused, undamaged, and in their original packaging. Items returned to us in anything less than brand-new, resalable condition will not qualify for a full refund. Gromstar reserves the right to apply deductions based on the condition of the returned product, with the level of deduction determined at our discretion.

3. Rental Programme Terms (rideGROMSTAR)

These terms apply only to customers enrolling in the rideGROMSTAR Bicycle Rental Programme.

3.1 Nature of Agreement

The Rental Programme allows you to hire a rideGromstar Bike, or Asset, for a recurring monthly fee. Assets of the Rental Programme are not guaranteed to be unused and may show signs of reasonable use. Gromstar warrants to you that the Bike provided to you will be;

- as specified on the website

- maintained and serviced to a sound mechanical and functional level.

This is a rental Agreement only — ownership of the bike always remains with Gromstar. You receive the right to use the bike during the rental period, subject to the conditions in this agreement. You may not sell, sublease, or otherwise transfer the bike or your rights under this agreement to anyone else.

Bikes from the Rental Programme are to be used exclusively by the sole rideGROMSTAR customer of a particular lease. The use of any rideGROMSTAR Assets in a commercial capacity are prohibited, and evidence that this has occurred will lead to seizing of the asset and termination of the agreement.

3.2 Minimum Term & Ongoing Rental

A rental starts on the date the bike is delivered to You, though grace periods to account for delivery may be implemented, at Gromstar’s discretion, to account for the delivery of a Bike.

A minimum rental period applies to every Agreement and is selected by the Customer at checkout. The Customer has the right to cancel the Agreement at any point before their minimum term elapses, however the Customer will still be billed monthly until the minimum duration is reached. In this instance, the Customer is entitled to keep their Asset until the minimum term is reached.

Without cancellation, the Agreement continues automatically after the minimum duration on a rolling monthly basis until the Customer cancels. Your Agreement continues until:

– You give sufficient notice to end the agreement, and

– The Bike is returned, inspected and approved.

3.3 Payments

Monthly rental fees are collected automatically using the payment method You provide, and will consist of the primary Asset’s monthly fee, as well as any additional services (Add-Ons).

Your first payment is taken on the day you sign up, with subsequent payments collected on the same date each month. A one-ff Delivery charge will occur at the initiation of a Rental Agreement and is subject to vary in line with current courier fees.

You must keep your payment details up to date at all times. If your payment method expires, fails, or is declined, you must provide a valid alternative immediately.

3.4 Failed Payments

Upon a failed payment, Gromstar will attempt to take payment twice more. We may contact you to request updated payment details. Gromstar reserves the right to, on the grounds of repeated failed payments;

– Terminate an Agreement and suspend your access to the Rental Programme,

– Request immediate return of the bike, and

– Apply charges relating to missed payments or recovery of the bike.

If the Bike is not returned when requested, you may be liable for the Asset’s full replacement cost, and may incur the hiring of a 3rd Party Debt Collection Agency to regain the lost value of the Bike.

3.5 Your Responsibilities

You must take reasonable care of the Bike at all times. This includes, but is not limited to:

– Storing the bike securely when not in use,

– Locking it appropriately when left unattended,

– Keeping it clean and in safe working order,

– Using it for its intended purpose only,

– Following all safety and maintenance guidance provided.

You must report any damage and/or faults with the Bike immediately via email, or within the rideGROMSTAR Hub. You must not alter or modify the Bike unless agreed with Gromstar in writing.

3.6 Wear & Tear / Damage

Upon return of a Bike at the end of an Agreement, normal wear and tear is expected – in fact we want these bikes to be used for what they were built for! Normal wear & tear his includes tyre wear, brake pad wear, tube punctures, cable stretch, and minor cosmetic marks from regular use.

Exceptional Damage that goes beyond fair wear may be charged. Examples include:

– Crash or impact damage,

– Bent wheels, cracked frames, or broken components from misuse,

– Corrosion from poor storage,

– Use of non-approved parts or repairs.

Where a bike is returned in a condition requiring repair or replacement, We reserve the right to charge the cost to you based on the components and labour required.

3.7 Loss or Theft

In the event of an Asset being stolen or lost, you must immediately notify Gromstar, providing a crime reference number if applicable.

Unless explicitly specified, it is the responsibility of the Customer to insure the Asset in their possession, at their own discretion and expense (We recommend it).

In the event of absolute loss of an Asset, the Customer is responsible for the full replacement value of the bike.

We may charge up to the current retail price of the Asset.

If the Asset is recovered at a later date, ownership remains with Gromstar, not the customer.

3.8 Exchanges & Upgrades

If you, or your child, outgrows the bike, you may request an exchange. We will advise on any swap fees, delivery charges, or differences in rental price at the time of the request. Upgrades to higher-spec models may involve an increased monthly rental fee, which will occur upon delivery of the new Bike.

Gromstar reserves the right to withhold exchange Bikes until proof of postage of the to-be-exchanged Bike has been provided by the Customer.

All exchanged Bikes are subject to the same conditions outlined in Section 3.6.

3.9 Servicing & Repairs

After delivery & acceptance of the Asset by the Customer, the ongoing maintenance and upkeep of the Bike is the sole responsibility of the Customer. If a Bike arrives to a Customer with a fault, contact us immediately via email, or via the rideGROMSTAR Hub.

If a Bike develops a mechanical issue that is not caused by misuse, contact us for guidance via email, or report via the rideGROMSTAR Hub.

Repairs carried out by third parties without Our approval may result in additional charges or termination of the agreement.

The specification of a Bike is not to be changed, and any repairs or replacements to Bikes, though the Customer’s responsibility, must be approved by Gromstar.

Continuing to use a bike that is clearly damaged or unsafe may be treated as negligence.

3.10 Returning the Bike (End of Term or Cancellation)

To cancel your Rental Agreement, you must notify Us using the method specified during signup, and provide sufficient notice to avoid paying Your next scheduled monthly fee. Notice periods are defined at checkout.

The Rental Agreement ends only when the bike is returned to us, inspected and approved.

The bike must be returned:

-  Clean,

-  Fully assembled,

-  Of the same specification as it was delivered to you,

-  In safe working order,

-  Showing only fair wear and tear.

Where the Bike shows excessive damage, missing parts, or neglect, we may apply charges based on the repair or replacement cost.

If you fail to return the Bike by the agreed date, Your subscription will reactivate, and monthly fees may continue to be charged until it is received.

3.11 Early Termination by Gromstar

We may end your agreement immediately if:

– Payments are repeatedly missed,

– You breach any important term of this agreement,

– You fail to return the bike when requested,

– We have reasonable grounds to suspect fraud, misuse, or unlawful activity.

If terminated, the bike must be returned immediately.

Failure to do so may result in the full replacement value being charged.

4. Liability & Limitation

Gromstar is not liable for any indirect, incidental, or consequential losses arising from your use of the website, any products purchased, or any bikes hired through the Rental Programme. This includes loss of profits, loss of data, loss of opportunity, or any other non-direct damages.

You are responsible for ensuring that any product or Rental Asset supplied by Gromstar is used safely and appropriately. This means checking the bike before use, supervising children where required, and using the bike only for its intended purpose. We are not responsible for injury or damage resulting from the use of products purchased from Gromstar, nor from the use of Assets from the Rental Programme.

During a Rental period, responsibility for care, security, and safe use of the bike sits entirely with you. Gromstar is not liable for loss, theft, third-party damage, or issues caused by non-approved repairs or modifications. You must report problems or faults promptly; continuing to use a damaged or unsafe bike may result in extra charges and is at your own risk.

We are also not liable for delays or disruptions caused by courier services, website outages, or events outside our control. Nothing in this section affects your statutory rights, nor does it limit liability where such limitation is prohibited by law.
